LICENCE POUR UNE VIDÉO: Tourisme Montréal, par la présente, vous accorde une licence gratuite, personnelle, limitée, non transférable, ne pouvant être accordée sous licence, révocable et non exclusive, vous permettant d'utiliser les vidéos choisies ou des composantes des vidéos tel que le contenu audio ou des images des vidéos (le « Matériel ») aux conditions suivantes :
1.L'utilisation qui sera faite du Matériel devra être à caractère non commercial et dans le seul but de faire la promotion de la destination touristique de la ville de Montréal. Ce Matériel ne peut en aucun cas être utilisé dans le cadre de campagnes ou être lié à quelque matériel publicitaire.
2.Le Matériel ne peut en aucun cas être utilisé à des fins de vente ou de revente (DVD, etc.).
3.En accordant la présente licence, Tourisme Montréal ne transfère en aucune façon la propriété intellectuelle relative au Matériel, qui demeure sa propriété exclusive ou celle de ses concédants de licence. Tous les droits non accordés en vertu des présentes Conditions demeurent exclusifs à Tourisme Montréal.
4.Cette licence n’autorise pas de tiers à utiliser le Matériel sans la permission écrite de Tourisme Montréal.
5.Toutes autres utilisations du Matériel autrement que celles prévues par la présente licence sont strictement interdites à moins d'une autorisation écrite de Tourisme Montréal. Vous ne pouvez modifier, publier, transmettre, participer au transfert ou à la vente, créer des œuvres dérivées ou exploiter de quelque manière que ce soit le contenu, en tout ou en partie. Sauf autorisation expressément prévue par la loi sur le droit d’auteur, aucune reproduction, redistribution, retransmission, publication ou exploitation commerciale du matériel téléchargé ne sera autorisée sans l’autorisation expresse de Tourisme Montréal et du titulaire du droit d’auteur. Si la copie, la redistribution ou la publication de matériel protégé est autorisée par le droit d’auteur, aucun changement ou aucune suppression de l’attribution de l’auteur, de la mention de crédit ne doit être effectué(e).
6. Tourisme Montréal pourra révoquer la licence advenant tout défaut de respecter les engagements des présentes. Vous devrez alors cesser immédiatement toute utilisation du Matériel.
7.Ce Matériel vous est fourni « tel quel » sans garantie de quelque nature que ce soit.
8.Selon ce qui est permis par la loi applicable, en aucune circonstance Tourisme Montréal ne sera responsable envers vous ou une tierce partie pour tout dommage direct, indirect ou exemplaire pouvant survenir de la fourniture, de l’utilisation, du fonctionnement ou du mauvais fonctionnement de ce Matériel.
LICENCE FOR A VIDEO: Tourisme Montréal hereby grants you a royalty-free, personal, limited, non-transferable, non-licensable, revocable and non-exclusive license to use the selected videos or components of the videos such as audio content or images from the videos (the "Material") subject to the following conditions:
1.The use of the Material is limited to non-commercial uses only, and for the sole purpose of promoting Montréal as a travel destination. The material may not be used for advertising campaigns.
2.The Material shall not in any way be used for the purpose of selling or reselling promotional items, goods and services, or for commercial gain.
3.By granting this license, Tourisme Montréal does not transfer in any way the intellectual property in the Material, which remains the exclusive property of Tourisme Montréal or its licensors. All rights not granted under these Terms shall remain exclusive to Tourisme Montréal.
4.This license does not authorize any third party to use the Material without the written permission of Tourisme Montréal.
5. Any other use of the Material other than as provided in this license is strictly prohibited unless authorized in writing by Tourisme Montréal. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Material, in whole or in part. Except as expressly permitted under copyright law, no reproduction, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of Tourisme Montréal and the copyright owner. If copying, redistribution or publication of copyrighted material is permitted, no change or deletion of author attribution or credit shall be made.
6. Tourisme Montréal may revoke the license in the event of any failure to comply with the terms of this agreement. You must then immediately cease all use of the Material.
7.This Material, is provided “as is” without warranty or condition of any kind.
8.To the maximum extent permitted by applicable law, in no event shall Tourisme Montréal be liable to you or any third party for any direct, indirect, special, consequential or exemplary damages arising out of the supply, use performance or misperformance of this Material.
